Mission
of the Legal Affairs Committee
The
Board of Trustees strives to oversee the
management of the District’s resources
so that those resources are available to
support the success of all students. To
this end, the Legal Affairs Committee will
provide effective oversight of the District’s
dispute resolution processes to ensure that
the District’s legal risks are managed
in a way that achieves the cost-effective,
fair, equitable, prudent and timely resolution
of all disputes.

NOTICE
IS HEREBY GIVEN THAT THE LEGAL AFFAIRS COMMITTEE
MEETING OF THE BOARD OF TRUSTEES OF THE ALAMO COMMUNITY
COLLEGE DISTRICT WILL BE HELD ON THE 27TH DAY OF
SEPTEMBER 2005. THE MEETING OF THE COMMITTEE WILL
CONVENE IN OPEN SESSION AT 6:45 P.M.
This
meeting of the Legal Affairs Committee of the Board
of Trustees, being held for the reasons listed below,
is authorized in accordance with the Texas Government
Code, Sections 551.001 - 551.146. Verification of
Notice of Meeting and Agenda are on file in the
office of the Chancellor. Executive Session, if
required, is authorized by the statute and will
be conducted prior to the conclusion of the meeting.
If, during the course of the meeting, any discussion
of any item listed on the agenda should be held
in Executive Session, the Committee will convene
in such Executive Session in accordance with Texas
Government Code Sections 551.071 - 551.084. The
Committee must take action in the open portion of
the meeting on items discussed in the Executive
Session. The Committee will consider, discuss, and
take appropriate action regarding the following
items:

a. Under §§ 551.071(1)(A) and (B), Texas
Government Code, the Committee will consult with
its attorneys about pending litigation, including
William Miller vs. ACCD; Angela Campos vs. ACCD;
Howard Crowell et al. vs. ACCD; Browning Construction
vs. ACCD; Janette Grant vs. ACCD; Delia Joseph vs.
ACCD; Arturo Hernandez vs. ACCD.
b. Under § 551.071(2), Texas Government Code,
the Committee will consult with its attorneys, both
in-house and retained, about:
(i)
RFP for legal, mediation, facilitator, and miscellaneous
services
(ii) Pending Charges of Discrimination lodged with
the U.S. Equal Employment Opportunity Commission
by the following past and present ACCD employees:
Juan Alvarado, Henrietta Andrade, Steve Chelewski,
Duane F. Conley, Larry Edmond, Joan Fabian, Theresa
Martinez Fayette, Sally Hoppstetter, Delia Joseph,
Karen Marcotte, Debra Sanchez, Phillip C. Shannon
and Cheryl Williams
(iii) Solicitation for proposals for legal, mediation,
facilitation, and investigative services
(iv) Issues pertaining to District-wide risk management,
including policies of general liability insurance
and other lines of coverage
(v) The status of civil recovery actions against
former ACCD administrator Joan Drennan-Taylor and
former Trustee Jesse Gonzales
(vi) Update on settlement negotiations with USEPA
and other parties in the Gulf Nuclear Superfund
Site matter
(vii) Regulatory compliance issues involving pesticide
application at San Antonio College
(viii) Legal issues raised by ACCD’s response
to Hurricanes Katrina and Rita
Any
action on these matters will be taken in Open Session.
At 8:15 p.m. the Committee will reconvene in Open
Session; any item in Executive Session not discussed
prior to 8:15 p.m. will be discussed when the Committee
reconvenes in Executive Session
