
ACCD Parking Rules and Regulations
I. Introduction
A. Department
of Public Safety Officers of the Alamo Community College District are
commissioned by the Governing Board of Trustees and licensed by the state of
B. Nothing in these regulations
is intended to limit or restrict the authority of the Alamo Community College
District to promulgate and enforce appropriate rules and regulations for the
orderly conduct of the District in carrying out its purposes and objectives or
the right of separate jurisdiction relating to the conduct of its students and
personnel.

motor vehicle or bicycle on the property of the Alamo Community College
District is a privilege granted by the District and is not an inherent
right of any employee, student, or visitor. All employees or students who have
vehicles in their possession, or control for use, or operation, who park on the
property of the District must purchase and properly display a Vehicle
Registration Tag/Decal.

OF A VEHICLE REGISTRATION TAG OR DECAL
E. Campus parking
Enforcement personnel as may be designated by the Administration are empowered
by the Board of Trustees to issue District Administrative citations for violations
of the District Traffic/Parking Rules and Regulations. Campus Parking
Enforcement personnel may be full-time, part-time, work-study or student
assistant personnel employed by the Department of Public Safety. Only peace
officers (Public Safety Officers) can issue citations that can be processed
through the courts.
II. Definitions
Campus is
defined and understood to include all property at St. Philip's College and
Southwest Campus,
Motor vehicle is
understood to include automobiles, trucks, scooters, motorcycles and
motorbikes.
Driver is
every person who drives, operates or is in actual physical control of a motor
vehicle.
Student is every
person duly registered, enrolled and attending classes offered by the Alamo
Community College District.
Employee is
every person permanently or temporarily employed by the Alamo Community College
District, regardless of whether the person is employed with salary or without
salary; to include those persons who perform a service to the Campus.
Pedestrian means
any person afoot.
Registered Owner is
defined as the person who registers with the Alamo Community College District
in order to obtain a Vehicle Registration Tag/Decal or with the state in which
licensing of the vehicle was issued.
Visitors are
those individuals who conduct business with or who render a service to the
Alamo Community College District and who are not otherwise eligible for parking
privileges. Students and
employees are prohibited from parking in visitor spaces at St. Philip's
College, St. Philip's College Southwest Campus,
Vehicle Registration Tag/Decal may be of any design or configuration as
designated and must be displayed in a manner as prescribed by the Alamo
Community College District.
Persons who have purchased an Alamo
Community College District Vehicle Registration Tag/Decal for the current year
or persons authorized to conduct business on ACCD properties may obtain
temporary Vehicle Registration Tags without cost from the Department of Public
Safety Offices. Temporary Vehicle Registration Tags will be issued to CE
students in accordance with the procedures as set down by the Administration in
respect to course duration and contact hours, All GED, E.S.L. and J.T.P.A.
students will be issued the CE Temporary Registration Tags regardless of
contact hours or course time span.
Police Citation shall
be described as a notice of violation issued for violation of the Texas Motor
Vehicle Laws and the Parking and Traffic Rules and Regulations of the Alamo
Community College District and shall be issued only by District Department of
Public Safety Peace Officers.
Administration Citation shall
be described as a notice of violations issued for violation of the Parking and
Traffic Rules and Regulations of the Alamo Community College District. Those
persons, as designated by the administration, may issue this citation.
III. General Provisions
A. Pursuant to the authority granted by Penal
Code Act 2.12 Sections 51.201 et seq., 54.005, 54.503, 65.31, and 71.01 et seq.
of Title 3 of the Texas Education Code, the Board of Trustees of the Alamo
Community College District has promulgated parking rules and regulations to
regulate and control parking and traffic and the use of parking facilities, to
provide for the issuance of motor vehicle identification and insignia (Vehicle
Registration Tag/Decal), and to provide for jurisdiction over offenses.
B. These regulations and procedures are applicable to any person on the
properties of the Alamo Community College District. These rules and regulations
are supplementary to the statues of the state of
C. The Alamo
Community College District is not responsible for fire, theft, damage to, or
loss of any vehicles parked or operated on ACCD properties.
D. The Alamo Community
College District reserves the right, under the provisions of Article 6687-9,
E. The District
shall not, nor shall any of its employees, be liable or assume any
responsibility for the loss or damage suffered because of such impoundment or
relocation of a vehicle.
F. When any person is charged with having
stopped, parked and left standing a vehicle on properties of ACCD in violation
of any provisions of the ACCD Traffic Rules and Regulations, proof that said
vehicle on the date and time of the offense was bearing a valid ACCD Vehicle
Registration Tag/Decal shall constitute evidence that said vehicle was then and
there stopped, parked and left standing be the holder of the Vehicle
Registration Tag/Decal. However, if the vehicle does not bear a valid ACCD
Vehicle registration Tag/Decal, proof that said vehicle on the date and time of
the offense alleged, was owned by an individual is evidence that said vehicle
was then and there stopped, parked and left standing by said individual.
G. On special occasions and in emergencies,
the Chief of Public Safety, or his/her designated representative,
may impose temporary parking and traffic control restrictions. These temporary
restrictions shall have all the force of other written regulation and shall be
subject to the same penalties.
IV. Vehicle Registration
A. Only motor vehicles with a valid
ACCD Vehicle Registration Tag/Decal properly displayed may park on campus.
Visitors to the campus are exempt from this requirement.
B. To obtain an ACCD Vehicle
Registration Tag/Decal, a person must be in possession of a valid campus
identification card and driver's license. Vehicle registration Tags/Decals may
be purchased from the business offices at any college campus.
(1) Employees may
purchase One (1) Decal/Tag at any of the Bursar's offices.
** Exemptions may be
authorized through the president's office.
a. Make, Year,
Model, Body Style, License Plate Number and state of registration must be
placed on the Vehicle Registration Form for all vehicles that will be using the
Vehicle Registration Tag/Decal.
C. Vehicle Registration Tags/Decals
are valid from September 1 through August 31 of the following year. The fee
charged for a registration Tag/Decal
is prorated according to the
registration period of the academic year. The fee for a vehicle registration
Tag/Decal is as follows:

Vehicle Registration fees
may be modified by the Chancellor.
D. Vehicle Registration is not a
refundable item even though the student or employee is not enrolled or employed
for the remainder of the academic year.
E. A Vehicle Registration Tag/Decal
will not be replaced, without fee, if lost or stolen. It is the
responsibility of each person to safeguard their Vehicle Registration Tag/Decal.
F. A Vehicle Registration Tag/Decal
will not be sold or issued to any person who has unpaid ACCD parking or traffic
violations.
G. The Vehicle Registration holder is
responsible for all parking violations issued against any vehicle displaying a
Vehicle Registration Tag/Decal registered in their name, regardless of operator
and violations incurred.
H. A Vehicle Registration Tag/Decal
will not be honored unless it is properly displayed and plainly visible from
the outside. Hang tags will be hung from the rear view mirror with registration
number visible from the front of he vehicle. Vehicle decals must be completely
affixed to the inside of the front windshield in the lower right side on the
passenger's side of the vehicle. Motorcycle decals will be affixed to one of
the front struts.
I. Students and Employees of the ACCD
will be required to display their County Tax Assessor Collector issued disabled
parking placard behind the ACCD vehicle registration tag/decal or have disabled
license plates appropriately displayed in order to park in spaces designated
for persons with disabilities.
J. Temporary Vehicle Registration
Tags/Decals may be issued to General Education Development Students, certain
Continuing Education Students, visiting lecturers, sales and service
representatives and temporary employees for a period not to exceed ninety (90)
calendar days. Exceptions are made for unusual circumstances and the issuing of
temporary Vehicle Registration Tags/Decals for an extended period of time is at
the discretion of the Chief of Public Safety. There is no fee for a temporary
Vehicle Registration Tag/Decal.
V. Traffic and Parking Regulations
A. The purpose of these regulations
is to provide for the safety and welfare of students, employees and visitors
and to provide for the control of traffic and parking.
B. If any part of these parking and
traffic regulations is held to be invalid, such invalidity shall not affect
other provisions which can be given effect without the invalid provision, and
to this end the provisions of these regulations are declared to be severable.
C. It shall be a violation to commit
any act prohibited by these regulations or to fail to do any act required by
these regulations.
001. Vehicles operated or parked on
the campus must comply with all state laws, and the Parking and Traffic Rules
and Regulations of the Alamo Community College District.
002. The speed limit on all parking
lots, streets, alleyways, and thoroughfares owned by the Alamo Community
College District will be ten (10) miles per hour.
003. The operation of a vehicle shall
be restricted to the campus drives, streets and parking lot.
004. No person shall fail or refuse
to comply with any lawful order or direction of anyone with the authority to
direct, control and regulate traffic.
005. The driver of
any vehicle involved in a collision shall immediately stop at the scene of such
accident or collision, and by the quickest means of communication report such
accident or collision to the District's Department of Public Safety.
006. All vehicles are required to
stop completely at each STOP sign, and then proceed cautiously without
creating a hazard to vehicles not required to stop.
007. No operator of a vehicle shall
drive beyond a barricaded area, or where prohibited by temporary or permanent
signs and no operator or person shall remove such barricade or sign.
008. No driver or operator of any
vehicle shall back any vehicle into an intersection or back upon any shoulder
or any traffic lane.
009. No person in control or possession
of a motor vehicle shall bring the same to a sudden start or stop in a parking
lot or street, or accelerate or race the motor so as to cause a loud noise in a
manner calculated to disturb the person or persons present.
010. Every motor vehicle operated on
a campus must be equipped with a muffler in good working order and in constant
operation to prevent excessive or unusual noise.
011. No person in control or
possession of a motor vehicle equipped with audio equipment shall play such
devices to the extent that such sounds are disruptive to the environment of the
campus.
012. Bicycles shall not be operated
on pedestrian walkways or sidewalks, except for Police Bike Patrol. Operation
of bicycles is regulated by Texas Motor Vehicle Laws.
013. The operator of a vehicle shall
yield right-of-way to pedestrians in crosswalks.
014. Pedestrians shall cross streets
at designated marked pedestrian crosswalks.
015. Every pedestrian crossing a
roadway at any point other than a marked crosswalk or within an unmarked
crosswalk at an intersection shall yield the right-of-way to all vehicles upon
the roadway (VCS 6701d, Art IX, Sec. 78a.)
016. Pedestrians
shall not leave the curb or other place of safety and walk or run into the path
of a vehicle which is so close that it is impossible for the driver to yield.
017. All vehicles operated or parked
upon the campus shall properly display a current ACCD Vehicle Registration
Tag/Decal.
018. Reserved parking spaces are
provided for individuals with restricted physical handicaps and administrators.
Special Vehicle Registration Tags/Decals are issued to identify these
individuals. Parking in a reserved parking space, by persons other than
designated, is prohibited.
019. No person in control or
possession of a motor vehicle shall park in any parking lot other than as
designated by the Vehicle Registration Tag/Decal on their vehicle. Employees
from the District Administration Office shall park in Faculty/Staff lot when
visiting other campuses.
020. Parking is restricted to white
lined parking spaces. Parking entirely within the marked boundaries of the
parking space is required at all times. The fact that other vehicles are parked
improperly shall not constitute an excuse for parking with any part of the vehicle
extended beyond the marked boundaries of the parking space.
021. No vehicle may be parked in any
area which has not been marked or designated as a parking space.
022. Vehicles shall not park in a
manner that obstructs walkways, sidewalks, driveways, ramps, loading zones or
marked crosswalks. Parking is not allowed where prohibited by signs, red curbs
or other markings on streets or parking lots.
023. It is prohibited to park, or let
stand, a motor vehicle in a loading zone or service drive unless actually
loading or unloading material or equipment. If the time for loading or
unloading exceeds more than thirty (30) minutes, the Department of Public
Safety Office must be notified of the extended parking requirements.
024. No person
shall park, or let stand, a motor vehicle on a campus for more than 48 hours
without prior authorization. Vehicles found in violation may be
considered abandoned and removed as provided in Article 6687-9,
025. No person may throw or deposit
any trash, litter or other waste on any parking lot, street or sidewalk.
VI. Enforcement
A. The Alamo
Community College District reserves the right to enforce traffic rules and
regulations:
1. Through
the impoundment of vehicles in violation of Texas State Statutes and the
Parking and Traffic Rules and Regulations of the Alamo Community College
District.
2. By
suspension of driving privileges on campus, revocation of Vehicle
Registrations, or denial to procure a Vehicle Registration Tag/Decal.
3. By
requiring either the vehicle owner or the person whose Vehicle Registration
Tag/Decal is displayed on the vehicle to be liable for administrative fees
imposed.
4. By barring the readmission to the
college and withholding the grades, degrees, refunds and official transcripts
of any student for non-payment of outstanding administrative fees.
5. By
disciplinary action against employees or students who fail to abide by these
regulations or failure to pay outstanding administrative fees.
B. Parking reinstatement fees and/or
fines are assessed for each Parking Violation Notice. The fee/fine is $12 if
paid within ten (10) school/work days from the date the Violation Notice was
issued. If not paid within ten (10) days, the fee will automatically increase
to $18.
C. Fees/Fines may be paid at the
Bursar's Office by presenting the Violation Notice(s) for payment or mailed to
the Bursar's office.
D. It shall not be
a defense to a violation of these Rules and Regulations that a citation was removed
from a vehicle after said citation had been placed on the vehicle.
VII. Parking and Traffic Appeals Procedure
Parking Violation Notices (citations)
may be appealed within ten (10) working/school days from date of the citation
by filing a "Citation Appeal From" with the Department of Public
Safety Office or Bursar's Office at each campus. The Chief of the Department of
Public Safety or his designated representative shall review all appeals to
determine validity of the citation. The individual is responsible for
contacting Department of Public Safety office to inquire on status of appealed
citation.
Each campus within the Alamo
Community College District shall be responsible for implementing and
maintaining a Parking and Traffic Appeals Committee to afford Due Process for
any person receiving a Parking Violation Notice (Citation), which procedure
shall be in printed form and be made available to all Employees and Students at
their campus.
THE DECISION OF THE
TRAFFIC AND PARKING APPEALS COMMITTEE SHALL BE FINAL.
VIII. Impoundment and Towing of Vehicles
Towing, will be used for unauthorized
parking in handicapped slots, blocking of another vehicle in parking lot, and
blocking driveways.
