Hazlewood Act

The Hazlewood Act (Article 2654 B-I) aids ex-veterans who have exhausted all of their VA educational benefits.  A legal resident of Texas is exempt from payment of tuition and certain required fees when the applicant meets all of the following conditions:

  1. The applicant must have served during a national emergency.
  2. The applicant must have resided in Texas one year prior to entering the service, and must have entered the service from Texas.  Upon discharge from the service, the applicant must continue to reside in Texas.
  3. The discharge must be HONORABLE or under HONORABLE CONDITIONS.
  4. VA Educational Benefits must have been exhausted or the veteran must be ineligible for VA benefits.
  5. The applicant must have served on active military duty ( other than for training) for more than 180 days.
  6. The applicant must apply for federal educational benefits such as the Pell Grant, the SEOG, and have eligibility verified.  The applicant cannot be eligible for educational benefits under Federal legislation (such as the Pell Grant and the SEOG) in effect at the time of registration (if eligible for a partial Pell Grant, the student may receive a partial Hazlewood exemption).  A student who has exhausted his or her "federal education benefit" as a result of a default on a federal loan may NOT receive the Hazlewood benefit.  A person is not eligible for the exemption if the person is in default on a loan made or guaranteed for educational purposes by the State of Texas.
  7. Exemptions under the Hazlewood Act shall not exceed a cumulative total of 150 credit hours, beginning with the Fall 1995 semester.

If the conditions listed above are met, the applicant must submit the following:

  1. A letter from the Department of Veterans Affairs stating that the veteran is ineligible or has no veterans' educational entitlement remaining;
  2. A copy of the applicant's DD214;
  3. A referral letter from the Financial Aid Office stating that the veteran does not qualify for the applicable for educational benefits.  A student aid report for the academic year;
  4. A Hazlewood application form.
This benefit is also available to children of the Texas service members who died while in military service or who are missing in action or prisoners of war; children of a Texas veteran who died of a service-connected disability; and children of a member of the Texas National Guard or the Texas Air National Guard killed since January 1, 1946, while on active duty either in the service of Texas or the United States.
